1. Acceptance of Terms

By accessing or using the Shiftix.AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including employers, workers, and visitors.

2. Description of Service

Shiftix.AI is an automation-first staffing platform for the hospitality industry. The Service connects employers who need to fill shifts with flexible workers who are available to work. Our matching engine automatically identifies suitable workers based on roles, availability, location, and reliability, sends invitations, and confirms placements. Shiftix.AI acts as a technology intermediary and is not an employer, employment agency, or staffing company.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Employer Obligations

As an employer using the Service, you agree to:

  • Provide accurate shift details including role, location, time, and pay rate
  • Comply with all applicable employment and labour laws
  • Pay workers the agreed rate for completed shifts
  • Provide a safe working environment for all workers
  • Not discriminate against workers on any unlawful basis
  • Pay the applicable platform fee for completed shifts

5. Worker Obligations

As a worker using the Service, you agree to:

  • Provide accurate information about your roles, availability, and experience
  • Honour accepted shift commitments and arrive on time
  • Notify the employer and platform promptly if you cannot fulfil an accepted shift
  • Maintain professional conduct during all shifts
  • Have the legal right to work in the applicable jurisdiction

6. Fees and Payment

Employers are charged a platform fee based on completed shifts. The current fee structure is displayed on the pricing section of our website. Payment processing is handled by Stripe and is subject to Stripe's terms of service.

We reserve the right to modify our fee structure with reasonable notice. Continued use of the Service after fee changes constitutes acceptance of the new fees.

7. Cancellations

Workers who accept a shift and subsequently cancel may have their reliability score affected. Repeated cancellations may result in reduced visibility in the matching algorithm or account suspension.

Employers may cancel posted shifts before they are confirmed. Cancellation of confirmed shifts may be subject to fees depending on the timing and circumstances.

8. Limitation of Liability

To the maximum extent permitted by law, Shiftix.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the fees paid by you to Shiftix.AI in the twelve months preceding the claim. The Service is provided on an "as is" and "as available" basis without warranties of any kind.

9. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Shiftix.AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

10. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
